In accordance with the provisions of the European Union Regulation 679 of April 27, 2016 for the protection of individuals with regard to the processing of personal data and the free movement of such data, OUTSTAND SOLUTIONS S.R.L., hereinafter also referred to as “Outstand” through this privacy policy presents you with the method by that your personal data is processed.

We note that we take very seriously the responsibility to protect the personal data you provide to us, and this privacy policy explains what types of data we collect, how we use and protect this data, and your rights regarding personal data processing.

Types of processed data

Your personal data that we process for the purpose of providing the services requested by you include the following categories of data:

  • Personal data processed in the context of the provision of SSM/ISU activities: name, surname, date of birth, CNP, home/residence address, company, position, date of employment, work schedule;
  • Personal data in the context of HR activity: name, surname, date of birth, CNP, identity card series and number, data related to professional experience, data related to studies, data related to the skills sheet, signature, data related to medical leaves and other data in the context of concluding employment contracts and personnel administration;
  • Professional data in the administration of commercial relations: name, surname, e-mail address, telephone number, fax number, function, company;
  • Other data: the information you provide when you want the services indicated on our website and information about your visits and use of this website, such as your IP address.
  • If applicable, contact details (name, surname), professional details (function), in case you want to publish a testimonial or review on our website or other media platforms (Facebook, Google, LinkedIn, etc.)

 

If you are an employee of a company for which we provide the services indicated above, we inform you that we process your name, surname, e-mail address, signature, department and position in order to be able to organize specific trainings, employment trainings, as well as any other trainings necessary professional, which can be organized physically, online or through the e-Learning application. Also, sensitive health-related data can be processed in the context of documenting work accidents or, as the case may be, other matters arising in the activity of ensuring occupational health and safety services

You do not have an obligation to provide the personal data listed above, however, please be aware that without them there is a risk that it will not be possible to provide the services you have requested.

Source of personal data

Most of the information we have is from you when you request services from Outstand, either directly from our website or indirectly from our collaborators or partners

Also, if you have, we will receive the data from your employer to be able to organize specialized training at your workplace or online.

The purposes and grounds on which personal data are processed

We will process your data to be able to provide consulting services at your request, namely informing you about the implementation stage of the requested services, communication and administrative management of the relationship with you as a client. We mention in this sense, by way of example, the following activities: providing the requested services/products, respectively (i) receiving and managing your requests (including those received online), (ii) issuing offers, (iii) performing the formalities prior to the conclusion of contracts , (iv) the execution of contracts concluded through the provision of services regarding occupational health and safety, emergency situations and human resources, as well as the delivery of products, as the case may be; (v) fulfillment of obligations and exercise of contractual rights, (vi) invoicing and distribution of invoices, (vii) archiving of the resulting documentation, (viii) carrying out correspondence in the context of the contract and maintaining the contractual relationship, as well as other operations performed for the purpose and basis of the execution of concluded contracts .

If you are an employee of the company for which we provide specialized services, we inform you that we process your data necessary to provide the services requested by your employer, namely the organization and conduct of specialized training.

Outstand can process your personal data based on the legitimate interest of the company, in order to carry out the following operations: i) analyze and improve our services and communications to you; (ii) evaluating your interests/preferences in order to identify and offer; (iii) the exercise and/or defense of our legal rights, (iv) the recovery of any claims, (v) the prevention of fraud, (vi) the resolution of potential disputes submitted to the courts, respectively for the appearance of a right in court.

Also, Outstand can process the personal data provided by you by publishing testimonials on the media platforms indicated above, testimonials offered in order to confirm an image of a safe and motivational work environment, as well as ensuring a high level of safety and trust of to people who interact and collaborate with Outstand. The applicable legal basis for publishing testimonials is your consent, freely expressed by publishing them on media platforms. Please note that the withdrawal of consent does not affect the legality of the processing carried out on the basis of consent before its withdrawal.

Last but not least, we inform you that there are cases in which we will process personal data to fulfill legal obligations, such as archiving, communication and reporting obligations to the authorities, institutions or state or governmental agencies.

Recipients of personal data

Outstand will transmit personal data to other natural or legal persons to whom there is a legal obligation to disclose them, or to whom disclosure is necessary in order to fulfill contractual obligations. In this regard, we mention the following categories of such recipients:

  • Accountants, auditors, other professional consultants, who will be obliged by law or by the concluded contract to keep your data confidential;
  • Public authorities from any field, central or local, both from Romania and abroad, that will process the data provided at their request or at our initiative, in accordance with the applicable legislation (for example: ITM, IGSU, ANPM ANAF, bodies of criminal investigation, etc.);
  • The competent court in Romania or in another state, in the event of a dispute, to the extent necessary for establishing, exercising or defending a right of Outstand;
  • Legal entities with whom Outstand is in contractual relations, being obliged by law or by the concluded contract to respect the confidentiality of your data, or being required to disclose your data by virtue of your responsibilities within Outstand.

 

Transfer of personal data to a third country or international organization

Currently, your personal data is processed in Romania/European Union territory. We inform you that, at this time, Outstand does not transfer and does not intend to transfer your personal data or part of it to other companies, organizations or individuals in third countries or to international organizations.
In the event of such a transfer, we will send you a new information notice in advance.

Duration of data storage

Your personal data will be kept by Outstand for the duration necessary to achieve the processing purposes indicated above, in compliance with the legal provisions applicable to the specific legislation in the matter of fiscal obligations, anti-fraud reports, as well as legal obligations regarding archiving.

Regarding your data processed in order to manage testimonials, we inform you that they will be stored for a period of 2 years from the moment you gave your consent for this processing. However, if you wish to withdraw your consent, we will withdraw this data from the website or media platforms on which it was published.

The absence of an automated decision-making process

We inform you that, as a customer and/or potential customer, you will not be the subject of a decision based solely on the automatic processing of your data (including profiling) that produces legal effects regarding you or that affects you in a similar way to a significant extent.

Security of your data

Outstand has implemented technical and organizational measures to ensure the protection of your personal data from unauthorized access and unauthorized modification, disclosure or destruction of processed data. By way of example, we bring to your attention the following:

– Staff training;
– Minimizing and/or anonymizing personal data, where possible;
– Limiting access to personal data, so that they are processed only by employees or collaborators who need access to information in order to fulfill legal or contractual obligations;
– Implementation of dedicated policies, including physical and technical security measures;
– Auditing Outstand suppliers to ensure the protection of processed data, in accordance with applicable legislation.

Your rights and how you can exercise them

Your rights are as follows:

  • The right of access to your data processed by Outstand, including the right to obtain information about the nature, processing and disclosure of this data;
  • The right to rectify inaccuracies in your data processed by Outstand;
  • The right to delete your data processed by Outstand (“the right to be forgotten”);
  • The right to restrict the processing of your data that Outstand processes;
  • The right to object to the processing of your data by Outstand or on behalf of Outstand;
  • The right to portability of your data to another data controller;
  • The right to withdraw consent, in situations where the processing of your data was carried out based on your consent. We note that you can make this request at any time, and the withdrawal of consent will not affect the legality of the processing of your data carried out before the withdrawal.
